Massage Works Therapy & Spa is a locally-owned massage therapy and esthetics spa with two locations in Fort Wayne, Indiana. Contact details — name, email address, phone number, and the content of any message you send us through our contact form, by email, or by phone.

Booking and account information — appointment history, service preferences, therapist preferences, and notes you provide when scheduling. Online booking is handled by our scheduling provider, Secure-Booker.

Health intake information — on your first visit and from time to time afterward, we ask about medical conditions, medications, recent surgeries or injuries, pregnancy status, allergies, skin sensitivities, and other information needed to deliver massage and esthetics services safely. We treat this information as confidential.

Payment information — credit card and other payment details are collected and processed by our payment processor and our scheduling provider. We do not store full card numbers on our own systems.

Membership information — plan type, billing schedule, benefit balance, and shared-benefit designations.

Marketing preferences — your consent to receive emails and text messages, and any opt-outs you tell us about.

Website usage data — when you visit our website, our hosting provider may automatically log basic technical information such as IP address, browser type, pages visited, and referring URL. We may use cookies or similar tools for site functionality and basic analytics.

3.How we use your information

We use the information we collect to:

• schedule and deliver massage, facial, waxing, and onsite services;
• adapt sessions to your health history and preferences;
• process payments and manage memberships and gift cards;
• respond to questions and requests sent through our contact form, email, or phone;
• send appointment confirmations, reminders, and follow-up messages;
• send promotional emails and text messages, only where you have opted in;
• maintain the security and integrity of our website and locations;
• comply with legal, tax, licensing, and recordkeeping obligations under Indiana and federal law.

4.Health information and confidentiality

We are not a HIPAA-covered entity in the way a medical clinic is, because we do not bill health insurance plans electronically. Even so, we treat health intake information as confidential. Intake forms and session notes are accessible only to your therapist and authorized staff, and are kept in secure paper or password-protected digital files.

If you choose to use a Health Savings Account (HSA) or Flexible Spending Account (FSA) card or request documentation for insurance reimbursement, additional information may be processed by your card issuer or insurer under their own privacy practices.

5.How we share information

We do not sell your personal information. We share it only with:

Service providers who help us run our business, such as our scheduling platform (Secure-Booker), payment processor, email and SMS providers, website host, and accounting software. These providers receive only the information they need and are required to protect it.

Professional advisors such as our accountant or attorney, where reasonably needed.

Legal and safety reasons — if required by subpoena, court order, or applicable law, or to protect the rights, property, or safety of our clients, staff, or business.

Business transfers — if we are ever involved in a merger, acquisition, or sale of all or part of our business, your information may transfer as part of that transaction, subject to this Policy.

6.Email and text message communications

With your permission, we send appointment reminders and promotional messages by email and SMS text. By providing your phone number when booking or signing up, you agree to receive transactional messages such as confirmations and reminders. Promotional text messages are sent only after a separate opt-in.

Message and data rates may apply. You can stop promotional emails at any time using the unsubscribe link, and stop text messages by replying STOP. Reply HELP for assistance, or contact us directly. Even after opting out of marketing, we may still send you transactional messages related to your appointments or memberships.

7.Cookies and analytics

Our website may use cookies and similar technologies to remember preferences, keep our site working, and understand how visitors use it. Most browsers let you refuse or delete cookies. If you do, some parts of the site may not function as intended. We do not use our website to deliver targeted advertising profiles to third parties.

8.How long we keep your information

We keep personal information only as long as we need it for the purposes described in this Policy or as required by law:

• Booking and client records are kept for the period required by Indiana professional licensing and tax recordkeeping rules.
• Health intake forms and session notes are kept for the period required for licensed massage therapy records, and securely destroyed afterward.
• Email and text marketing lists are kept until you unsubscribe or ask to be removed.
• Contact-form messages are kept only as long as needed to respond and document the conversation.

You can ask us to delete information that we are not required to keep by sending a request to office@MassageWorksFW.com.

9.Your Indiana privacy rights

Indiana residents have rights under the Indiana Consumer Data Protection Act regarding personal information that we control. Subject to the law's exemptions, you may request to:

Access the personal information we hold about you;
Correct inaccurate personal information;
Delete personal information we have collected;
Receive a copy of personal information you provided in a portable format;
Opt out of any sale of personal information, targeted advertising, or significant profiling. We do not sell personal information or use it for targeted advertising or profiling of this kind.

To make a request, email office@MassageWorksFW.com with the subject line "Privacy Request." We will verify your identity before responding and reply within the timeframe required by Indiana law. If we deny your request, you may appeal by replying to our response, and we will provide a written explanation of the appeal outcome.

10.Children's privacy

Our website is not directed to children under 13, and we do not knowingly collect personal information from children online. Minors who receive massage or spa services at our locations must be accompanied by a parent or legal guardian, who provides any required consent and intake information on the minor's behalf.
