Terms of Service.

These Terms of Service govern your use of the Massage Works Therapy & Spa website at https://www.massageworksfw.com and the services we provide at our two Fort Wayne, Indiana locations. By using our website, booking an appointment, purchasing a membership or gift card, or receiving services from us, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use our website or services.

You may use this website for personal, non-commercial purposes such as learning about our services and booking an appointment. You agree not to:

• copy, modify, distribute, sell, or lease any part of the website or its content;
• reverse engineer or attempt to extract source code from any software the website uses;
• remove copyright, trademark, or other proprietary notices;
• use the website in a way that interferes with its operation or other users' access.

All content on this website, including text, images, logos, and graphics, is the property of Massage Works Therapy & Spa or its licensors and is protected by U.S. copyright and trademark law.

We try to keep service descriptions, prices, and other information current and accurate, but the website may contain technical, typographical, or photographic errors. Prices, schedules, and availability are subject to change without notice. We do not warrant that any information on the website is complete, current, or error-free.

Our website links to third-party tools we use, such as our online scheduler and membership portal, as well as to other resources. We are not responsible for the content, availability, or practices of any linked site. Use of any linked site is at your own risk.

Appointments may be booked online, by phone, or in person. We recommend arriving 10 to 15 minutes before your first appointment to complete an intake form. Out of respect for the next client, sessions begin and end at their scheduled times. If you arrive late, your session may be shortened to fit the remaining time, and the full price still applies.

Please give us at least 24 hours' notice to cancel or reschedule a single-service appointment, and at least 48 hours' notice for couples massages, packages, parties, and onsite or event bookings.

• Late cancellations (less than the required notice) may be charged 50% of the service price.
• No-shows may be charged 100% of the service price.
• A valid credit card or gift card is required to hold longer or higher-value bookings.

Membership benefits used to book a missed appointment may be forfeited. We understand that emergencies happen and will use reasonable judgment in those situations.

Massage and esthetics services are not a substitute for medical diagnosis or treatment. Before your first session, and as your health changes, you must accurately disclose conditions including but not limited to: pregnancy, recent surgery, blood clots or clotting disorders, infectious or contagious skin conditions, recent injuries, severe heart or circulatory issues, and any allergies. Some conditions require clearance from a physician before we can provide service.

Your therapist or esthetician may decline, modify, or end a service when, in their professional judgment, the service is not appropriate or safe. Failure to disclose a relevant condition releases Massage Works Therapy & Spa from related liability to the fullest extent permitted by Indiana law.

You are draped at all times during massage; only the area being worked on is uncovered, and only with your consent. You may ask your therapist to adjust pressure, change technique, skip an area, or stop the session entirely at any time. We encourage you to speak up — your comfort is part of doing the work right.

All services provided by Massage Works Therapy & Spa are strictly therapeutic and professional. Sexually suggestive comments, gestures, advances, or requests of any kind will result in the session ending immediately. The full price of the service will be charged, the client will not be permitted to rebook at either location, and law enforcement may be contacted if appropriate.

Our therapists and estheticians may also end a session at their discretion if a client is intoxicated, abusive, or behaving in a way that compromises safety or professional standards.

Clients under 18 must have written consent from a parent or legal guardian, and a parent or legal guardian must remain on the premises throughout the appointment. For clients under 16, a parent or legal guardian must be present in the treatment room. We may decline to provide service to minors at our discretion.

Prices listed on our website and menus are in U.S. dollars and are subject to change without notice. Indiana sales tax is added where applicable. Gratuity is appreciated but not required, and gratuity is never required when redeeming a membership benefit, gift card, or promotional offer.

We accept major credit cards, debit cards, and HSA/FSA cards where allowed by your plan. Payment is due at the time of service. Services rendered are non-refundable. Unused prepaid services may be transferred or, at our discretion, refunded as account credit. Retail products may be returned within 14 days of purchase if unopened and in original condition.

Our memberships are governed by the plan details on our membership page and these Terms. Key points:

• Monthly plan — one 60-minute massage or facial each month, billed monthly with a 12-month minimum commitment. Unused monthly benefits roll forward while the membership is active. The monthly plan is for the primary member only.
• 6-month and 12-month plans — paid in full, may be used any time within the plan window, and may be shared with one additional named person at no extra cost. The 12-month plan includes one bonus benefit (13 total).
• Member rate — members receive a discounted rate on additional massages, facials, and select retail products.
• Freeze, transfer, and cancel — monthly plans may be frozen for medical reasons with documentation. Cancellation after the 12-month commitment requires written notice. Paid-in-full plans are non-refundable but unused benefits may, at our discretion, be transferred.
• Expiration of benefits at cancellation — once a membership is canceled, accumulated benefits must be used within 60 days unless otherwise required by law.
• Price changes — we will give at least 30 days' notice before changing membership prices for active members.
• Membership benefits are redeemable at either Fort Wayne location, are not transferable except as described above, and have no cash value.

Gift cards are available in dollar amounts and for specific services. Consistent with Indiana law, the dollar value of a gift card does not expire and we do not charge dormancy or service fees against the dollar value. Service-specific gift cards (for example, "60-minute massage") are honored at current menu pricing; if menu prices change, the holder may pay or receive the difference. Gift cards are not redeemable for cash except as required by law, and lost or stolen gift cards cannot be replaced unless we have a record of purchase.

We will not photograph, video, or quote you for marketing purposes without your written consent. If you choose to share a public review, you grant us permission to share that review on our website and social channels with attribution as you provided it.

We strive to make both Fort Wayne locations and this website accessible to clients with disabilities. To the fullest extent permitted by Indiana law, Massage Works Therapy & Spa and its owners, employees, and contractors will not be liable for any indirect, incidental, consequential, special, or punitive damages, including loss of profits, data, or goodwill, arising out of or related to your use of the website, our services, or these Terms, even if we have been advised of the possibility of such damages. Some jurisdictions do not allow these limitations, so they may not apply to you.

You agree to indemnify and hold harmless Massage Works Therapy & Spa, its owners, employees, and contractors from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your misuse of the website, your breach of these Terms, or your failure to disclose a relevant medical condition.

These Terms are governed by the laws of the State of Indiana, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or our services will be brought exclusively in the state or federal courts located in Allen County, Indiana, and you consent to the personal jurisdiction of those courts.

Before filing any legal action, please contact us at office@MassageWorksFW.com so we can try to resolve the issue directly. Most concerns can be addressed quickly with a conversation.

We may update these Terms from time to time. The "Last updated" date at the top of the page reflects the current version. Material changes will be posted prominently on the website. Your continued use of our website or services after the effective date means you accept the updated Terms.

If any part of these Terms is found unenforceable, the remaining provisions stay in effect. These Terms, together with our Privacy Policy, any service-specific terms, and any membership or gift card terms you accept, are the entire agreement between you and Massage Works Therapy & Spa regarding your use of our website and services.
